 11) Marital Complex Trust

  • The Marital Complex ILIT is a Co-Grantor Irrevocable Life Insurance Trust (ILIT) designed for a married couple. It provides all of the same features and benefits of the Marital Basic Trust ILIT (Product #10) including the structure for holding last-to-die policies.

  • The added provisions that are allowable in this format are complex distribution provisions. The grantors can stipulate whether they require that certain (multiple) ages must be attained by a vested beneficiary(s) before such beneficiary receives his distribution outright from the trust (Systematic Distribution) or that the trust would hold a beneficiary’s vested share in-trust until the beneficiary decides to withdraw a portion or all of his share by a written notice to the trustee (Convenience Withdrawal).
